ABOUT THE BUYER...

In the Republic of Croatia properties may be purchased by all its citizens and the citizenship is proven by certificate of Croatian citizenship, passport, or identity card.

As regards citizens of other countries that Croatia has signed a reciprocity agreement with, they too may purchase properties in Croatia according to determined procedure; the executed sales contract must be delivered to the Ministry of Foreign Affairs of the Republic of Croatia, which provides a consent after which the property sale tax is paid and registration of title deeds made.

ABOUT THE SELLER...
properties may be sold in Croatia by all domestic and foreign legal and natural persons
ON VALIDITY OF DOCUMENTATION...

By the sales contract the seller undertakes to hand over to the buyer the respective property in such a way as to ensure that the buyer obtains the right of ownership thereof, and the buyer undertakes to pay to the seller the agreed price (Art. 454/1 ZOO)

at certification of the sales contract, it is necessary to certify the signature of the seller, while certification of the buyer's signature is not obligatory

sales contract may be certified abroad too, preferably at a Croatian diplomatic mission and consular post, and if certified by a notary public, it must be translated into Croatian by a certified court interpreter

ABOUT THE PAYMENT...

capital transfer tax in Croatia amounts to 5% of the price specified in the contract and/or the estimate of the competent tax administration in the area of the property

property swap tax in the amount of 5% must be paid by both owners of properties each for his property

capital transfer tax is paid by the buyer (or seller on behalf of the buyer if so agreed)

capital transfer tax is not paid by the seller unless the purchased property is sold prior to expiry of three years from the day of the purchase of the property in which case the seller must pay tax on the difference between the purchase and selling price

the buyer must himself file a tax return to the competent tax administration and he must pay the tax within 15 days after the date of issue of tax administration decision

are public records on the legal status of properties as applicable for the purpose of legal trade (Art. 1/1 ZZK)
PROPERTY...
is a land plot together with all that is attached to it on relatively permanent basis, either on or under the surface thereof, unless otherwise provided by the law (Art. 3/3 ZV)
